Personal Rights The licensee shall ensure that each child is accorded the following personal rights: To be free from …unusual punishment, infliction of pain, humiliation, intimidation …or other actions of a punitive nature... This requirement was not met as evidenced by: Based on staff interviews, Staff #5 escorted Child #1 by the wrist to prevent Child #1 from hitting, fleeing, and while Child #1 was pulling away. This resulted in redness to the child’s wrist. This poses a potential risk to health, safety and personal rights to the children in care.

This requirement was not met as evidenced by: records review and interviews. LPA Ocegueda obtained corroborating interviews and photos that revealed staff #1 picked up child #1 during a tantrum to place child in "time out" area and in doing so, caused markings on his/her armpit area. This poses a potential risk to the health, safety and or personal rights to children in care.
