Staffing Ratio and Capacity (a) The capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time. This requirement is not met as evidenced by: Based on LPA's observation, upon LPA's arrival to the facility at 11:00 AM LPA observed 8 children (2 to 5 years old) were present in the facility with licensee's assistant, Seda Ghazarayn. At 11:05 AM licensee arrived to the facility, licensee was operating out of her license limitation with two children, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care.
