This requirement is not met as evidenced by children biting other daycare children. Based on interviews conducted, the licensee failed to ensure that children in daycare are receive safe, healthful, and comfortable accommodations. This poses an immediate health and safety risk to children in care.

Personal Rights: Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: To be free from corporal punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: Licensee submitted a video showing staff #1 hitting child #1 on the hand as a punishment for using markers. This is an immediate risk to children in care
Personnel Requirements (c) The licensee and other personnel as specified shall complete training on preventive health practices, including pediatric cardiopulmonary resuscitation and pediatric first aid, pursuant to Health and Safety Code Section 1596.866. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above: LPA observed Licensee's CPR expired in January 2022 which poses/posed a potential health, safety or personal rights risk to persons in care.
