(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above. The instructor for the Webby Dance Company, Ashley Kim, was allowed to be unsupervised by qualified facility staff during sessions provided to children in care. Ashley Kim is not employed by the facility and does not have a facility file to verify if they are qualified to supervise children without a staff member and although they have a criminal record clearance, they are not associated to the facility which poses an immediate health, safety or personal rights risk to persons in care.

Per Director, Ashley Kim has been providing dance services for 3 years. Ashley Kim has a criminal record clearance but the clearance was not transfered to the license prior to conducting dance sessions which poses an immediate health, safety or personal rights risk to persons in care.
