Personal Rights (1) The center shall give each authorized representative a copy of the Personal Rights form (LIC 613A [9/96]). This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in 1 out of 6 instances which poseses a potential risk to the personal rights of children in care.
Administration of Child Day Care Licensing (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. Based on an interview that was conducted with director on 03/20/23 and LPA's children file review, 9 current parent did not receive 03/01/23 Type A citation report. This poses a potential health, safety, and personal right risks to the children in care.
Personal Rights--To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to:etc... This requirement is not met as evidenced by: Per director, she will have a meeting with all staff to ensure to follow each child's personal right and use proper wording for children. Based on staff#1 interview, during the week of 02/05/23, while child#7 was peeling lips and had blood on face and fingers, staff#1 stated would put tape on child#7's mouth in order to prevent child#7 to touch mouth. This poses an immediate health, safety and personal right risk to children in care. LPA referred director to Community Care Licensing Child Care Center Operators online videos.
