Pool Safety (a) A licensed family daycare home operated at a private single-family dwelling with an in-ground swimming pool on the premises shall comply with all of the following requirements: (2) The licensee shall have the following safety equipment visible from the swimming pool and readily available for immediate use: This requirement is not met as evidenced by: Based on observation, interview, record review, the licensee did not comply with the section cited above in which poses/posed a potential health, safety or personal rights risk to persons in care. Licensee was not aware of regulation that took into effect in 2025. (I) An alarm that, when placed in a swimming pool, will sound upon detecting an entrance into the water.(B) A rescue pole with a body hook and a minimum fixed length of 12 feet. (c) Life Ring that is certified by USCG.

General Provisions and Definitions (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on observation, interview and record review the licensee did not comply with the section cited above in which poses/posed a potential health, safety or personal rights risk to persons in care. LPA Garcia observed that in the inspection prior it was discussed that staff needed to show proof of immunization.

Licensee stated that the child's parents did not want to vaccinate their child and LPA Garcia observed a hand written note from parents in the child's file that states "have refused to vaccinate my son..due to personal and private beliefs..."
