This requirement was not met as evidenced by staff disclosures. On March 15, 2023, a staff member placed a shelf in front of an exit door in an attempt to prevent children from leaving the classroom. LPA observed that teachers, Emely Galdamez and Nancy Clara, are present in the facility and do not have a criminal record clearance on file. Both staff have been in the facility for approximately three to four months. This is an immediate risk to the health and safety of children in care. Civil penalties are being assessed.

- Responsibility for Providing Care and Supervision No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by disclosures in interviews. On 07/29/22 S#1 left a child unsupervised. The teacher came in from the playground with the children and went to the classroom. A child was left in the hallway and the security guard that stays in the hallway found the child approximately 1-2 minutes later. The security guard informed the Assistant Director. The Assistant Director then took the child to the classroom where S#1 was serving lunch. This is an immediate risk to the health and safety of the child in care.

On 07/13/22, a parent observed Staff #1 spray a child with a spray bottle on his head while he was crying, the child rubbed his head and started crying more. Parent observed Staff #1 walk away from the child while he was crying. The incident was reported by the parent to administration on 07/15/22. This was a violation of the child's personal rights. This was an immediate risk to the health and safety of the child in care.
