Food Service (1) All food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner. Personal Rights: The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment, infliction of pain... This requirement was not met as evidence by: Based on interviews conducted and record review, S1 has had a history with facility adminstration and staff about having a stern/harsh tone with children in care. C1 stated that S1 grabbed C1 right upper arm where bruising and nail marks were embedded on C1 upper arm. This poses an immediate health and safety risk for children in care.
Teacher-Child Ratio. The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. This requirement is not met as evidenced by: During the walk through, LPA observed 17 children with 1 teacher and 1 aid in PS-B room, and 21 children with 1 teacher and 1 aid in the Twos room, which poses an immediate health, safety or personal rights risk to persons in care. This is a repeat violation within 12 months Civil Penalty assessed.

This requirement is not met as evidenced by: Based on observation,interview and record review, the licensee did not comply with the section cited above, during the tour with director, LPA observed in the PS-B classroom, 17 children supervised by 1 teacher and 1 aide, in the Twos classroom, 18 children supervised by 1 teacher and 1 aide. PS-B classroom was out of ratio by 2 children, Twos classroom was out of ratio by 3 children. which poses an immediate health, safety or personal rights risk to persons in care.
Personnel Requirements (1) Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure.
