- 101231 Smoking Prohibition (a) Smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). This requirement is not met as evidenced by: Based on LPA observation, the Licensee failed to ensure that the facility remained free of smoking or vaping as required. On 03/23/2026 at approximately 10:02 a.m., LPA observed staff member S3 vaping in the attic/storage room located directly above the licensed child-care areas where children are in care. Vaping in or above the facility poses an immediate health, safety or personal rights risk to persons in care.
