102417(a) -Operation of Family Child Care Home.The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This is evidenced by: The licensee's assistant took Child #1 to the wrong elementary school. The child ended up on the playground and unsupervised. This is a Type A violation which is an immediate health and safety risk to children in care.

This requirement is not met as evidenced by: LPA Wheatley observed two adult assistants supervising children today without fingeprints. Both of the assistants have children enrolled in the day care. Based on LPA's observation and interview with the staff, the licensee did not comply with the section cited above in which poses an immediate health, safety or personal rights risk to persons in care.
