101161 Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidenced by: LPA observations of children co-mingling at 12:00pm, LPA observed 4 elementary children in the preschool playground. At 12:05pm LPA obderved a elementary child going into the preschool classroom to obtain there belongings. This is a immediate risk to the health and safety of the children in care.

This requirement is not met as evidenced by: (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. Based on interview, the licensee did not comply with the section cited above. The facility has not completed the water lead testing which poses/posed a potential health, safety or personal rights risk to persons in care.

This requirement is not met as evidenced by: (f) At least one staff member who is trained in pediatric cardiopulmonary resuscitation and pediatric first aid pursuant to Health and Safety Code Section 1596.866 shall be present when children are at the child care center or offsite for center activities. Based on record review and interview, LPA did not observe a EMSA approved pediatric first aid/cpr for any staff present at the facility. Per administrator states that they thought online classes were fine and she has scheduled an upcoming training for all staff. This poses a potential health, safety, and personal rights risk to children in care.
