(1) All containers used for storage of solid wastes, including moveable bins, shall have a tightfitting cover that is kept on; shall be in good repair; and shall be leakproof and rodent-proof. This requirement is not met as evidenced by: Based on LPA's observation during the inspection, the licensee did not comply with the section cited above in having a trash bin in the kitchen filled without a lid. This poses/posed a potential health, safety or personal rights risk to persons in care.

(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: LPAs Wheatley and Casillas observed Child #1 inside of the restroom unsupervised by staff/teacher. The teacher could not see the child from the classroom. Also, LPAs observed 3 children from the playground go the restroom unsupervised. This is an immediate risk to the health and safety of children in care.
