(e) An aide shall work only under the direct supervision of a teacher. This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above in that HS 2 and HS 4 did not have a teacher present. Each classroom had 2 aides- record reviews documents they were hired as teacher assistants which poses/posed a potential health, safety or personal rights risk to persons in care.

Personnel Requirements-Prior to employment or initial presence in the child care center, all employees and volunteers subject to a criminal record review shall: (2) Request a transfer of a criminal record clearance as specified in Section 101170(f). This requirement is not met as evidenced by: During LPA's inspection LPA called the Regional Office and determined through DSS Guardian Background Check System and Licensing Information System (LIS) that Staff #1-5 are fingerprint cleared; however, they are not associated to the facility. This poses a potential health and safety risk to children in care.
