The capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time.(3) More than six and up to eight children, without an additional adult attendant, only if the criteria in Section 1597.44 of the Health and Safety Code are met. This requirement was not met as evidenced by that LPA and LPM observed 8 children in care during today's inspection all under the age of 4. This is a potential health and safety risk in that licensee was not in compliance within specified ratios.

Operation of A Family Child Care Home (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. LPA observed medications that were accessible to children in care. This posed a potential health, safety or personal rights risk to persons in care.
