A licensed daycare center with an in-ground swimming pool on the premises shall comply with all of the following requirements: (1) The swimming pool shall be equipped with at least one of the following drowning prevention safety features: (A) An enclosure as described in subparagraph (A) of paragraph (1) of subdivision (a). This requirement was not met as evidenced by: LPA Hernandez’s observed a key lockable device that was not at least 60 inches above the ground. LPA also observed a vertical clearance of more than 2 inches from the ground to the bottom of the safe closing gate door. This poses a potential risk to the health, safety, or personal rights of children in care.

This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above. LPA and Director both reviewed children's sign in sheets. Upon reviewing 5 preschool children and 1 infant child were not signed in which poses a potential health, safety or personal rights risk to persons in care.

(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance... This requirement was not met as evidenced by: staff interview and record review. Interviws and record review revealed that on 11/2/2023 that staff #1 was supervising 17 children in the play yard alone. This poses a potential risk to the health, safety and or personal rights of children in care.

(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: interviews. Interviews revealed that staff #1 was turned away tending to another child and was approximately 30-35 ft away from child #1 who was on the play structure when he/she obtained an injury. No staff was near the play structure supervising children.This poses a potential risk to the health, safety and personal rights risk to the children in care.
