Pool Safety (a) A licensed family daycare home operated at a private single-family dwelling with an in-ground swimming pool on the premises shall comply with all of the following requirements: This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above, as 4 out of 4 required items under AB 2866 – The Pool Safety Act were absent. This poses a potential health, safety, and personal rights risk to persons in care. The missing items include: a life ring, a pool alarm, a safety hook, and pool inspection logs.

OPERATION OF A FAMILY CHILD CARE HOME- The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. During the investigation witnesses revealed that licensee did not provide adequate supervision to children resulting a child sustaining marks on the neck. This is a potential risk to the health, safety, or personal rights of children in care.
