- (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: interviews and record review. On 8/14/2023, staff #1 released child #1 to an unauthorized representative (adult #1) causing an absence of supervision when adult #1 walked outside with child #1. This poses an immediate risk to the health, safety and or personal rights of children in care. A 500.00 civil penalty was assessed today.

- Reporting Requirements. Upon the occurrence, during the operation of the childcare center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.This requirement was not met as evidenced by: record review and interviews. Facility representatives did not report child#1 being released to an unauthorized representative on 8/14/2023. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. (2) Licensees shall maintain a lead value at or below the Action Level of 5 ppb in all outlets subject to the testing requirements of these Written Directives, for the health and safety of children in care. (c) If testing indicates an Action Level Exceedance at any water outlet, the water from that outlet is deemed not safe to drink and an immediate response pursuant to section 101704 shall be required. Based on record review, two outlets at the facility contained a lead exceedance greater than 5.5 ppb. This poses a potential health, safety or personal rights risk to persons in care.
