Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above. While touring the facility, LPA observed Staff 2 escorting preschool children to the restrooms.The boys went into the boy’s restroom and the girls went into the girl’s restroom. Both restrooms are next to each other. Staff 2 came out of the boy’s restroom and girls were in the restrooms with no staff supervision, which poses a potential health, safety or personal rights risk to persons in care.
Administration of Child Day Care Licensing (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based onrecord review, the licensee did not comply with the section cited above inDuring staff file review LPA observed that 5 out of 5 staff did not have a current mandated reporter training certificate in file; which poses/posed a potential health, safety or personal rights risk to persons in care.
