Operation of A Family Child Care Home (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above. Upon LPA arriving at the facility, Licensee was not present at the home. LPA heard Child 3 crying from outside the facility.LPA called Licensee and confirmed she was not at home. Child 3 and Child 6 were in the home with 15 year old minor, which poses an immediate health, safety or personal rights risk to persons in care.

Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. Licensee stated she installed it on August 2023. Licensee installed an above ground swimming pool without prior licensing approval. The pool is not fenced allowing windows and sliding glass door direct access. There is standing water in the bottom of the pool (about 1inch or less), which poses a potential health, safety or personal rights risk to persons in care.
