Administration of Child Day Care Licensing Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision (f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above. Licensees adult son (adult #3) moved back in the home and although he was fingerprinted (per record review) on 9/8/2023, he had not yet been granted a criminal record clearance from the Department. This poses an immediate health, safety or personal rights risk to persons in care.

Staffing Ratio and Capacity (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above. Upon arrival, LPA observed that licensee was caring for 12 napping children unassisted. There was an adult (adult #3) home, however this adult was not a qualified assistant and was not observed caring or supervising children. This poses a potential health, safety or personal rights risk to persons in care.
