(a) The licensee shall ensure that each child is accorded the following personal rights, (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by: During the complaint investigation, it was revealed that Staff #1 (S1) grabbed Child #1 (C1) by the shoulder while attempting to prevent C1 from leaving the classroom. This action resulted in S1 scratching C1’s neck and leaving visible marks. This posed a potential health, safety, and personal rights risk to children in care.

This requirement was not met evidence by: Information was received that Fresno County Police Department was at the premises investigating an incident. During the unannounced Case Management-Incident conducted by LPA, it was disclosed that Staff #2 (S2) had put her upper body and arm over the children multiple times as an approach to have children falls asleep during napping time. This poses a potential health, safety, or personal rights risk to children in care.
