- Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption...prior to employment, residence, or initial presence in the facility. Based on observation and record review, it was found that two (2) staff members did not have the appropriate fingerprint clearance on record before working at the facility. This poses an immediate health, safety, or personal rights risk to children in care.

Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. Testing results with fractional ppb readings of less than 0.5 ppb shall be rounded down to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. (2) Licensees shall maintain a lead value at or below the Action Level of 5 ppb in all outlets subject to the testing requirements of these Written Directives, for the health and safety of children in care. (c) If testing indicates an Action Level Exceedance at any water outlet, the water from that outlet is deemed not safe to drink and an immediate response pursuant to section 101704 shall be required. This requirement was not met as evidenced by: Testing results from Dellavalle Lab indicating (ALE) of 16.0 ppb in outlet F. These results indicate out of compliance over (ALE) 5.5 ppb, which poses a potential health, safety or personal rights risk to persons in care.

- Report finding
- Responsibility for Providing Care and Supervision. No child(ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation. This requirement was not meet as evidenced by interviews. Staff #1 stood in the doorway to observed a child walking down the hallway to use the children's restroom in the Orange classroom. Child #1 pulled down child #2's pants and underwear and used a toy spatula inappropriately. Child #2 said, 'Teacher.' Staff #1 observed the inappropriate interaction. This is an immediated personal rights, health and safety risk to children in care. A civil penalty was issued.
