California Lead Action Level at Child Care Centers (a) California’s Action Level for lead in water at Child Care Centers is 5 ppb. (b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. (c) If testing indicates an Action Level Exceedance at any water outlet, the water from that outlet is deemed not safe to drink and an immediate response pursuant to section 101704 shall be required. This requirement was not met evidence by: Based on record review provided by LA Testing indicating (ALE) of 7.22 ppb in outlet A, preschool bubbler and 20.6 ppb in outlet B, preschool faucet. These results indicate out of compliance over (ALE) 5.5 ppb, which poses a potential health, safety or personal rights risk to persons in care.

(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: During the inspection, the LPA observed children going in to the bathroom (one at a time) and closing the door or keeping it slightly open, but the staff could not see the children. The staff were also observed to be standing at the doorway of the building and not close to the bathroom. This poses a potential health, safety or personal rights risk to persons in care.
