Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above . LPA's observed that there were three areas in the play yard along the fence that had a collection of water. The largest of the areas measured approximately 2ft by 2ft in size and were as deep as approximately 3.5 inches in depth. Per Site Supervisor, the water was collected from sprinkler water. Also in the play yard, was a water table that had approximately 1 inch to 1.5 inches of water collected inside. Per Site Supervisor, the water in the water table had been there since approximately 2 hours prior from the time of observation. This poses a potential health, safety or personal rights risk to persons in care.

California Lead Action Level at Child Care Centers (a) California’s Action Level for lead in water at Child Care Centers is 5 ppb. (b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. (c) If testing indicates an Action Level Exceedance at any water outlet, the water from that outlet is deemed not safe to drink and an immediate response pursuant to section 101704 shall be required. This requirement was not met evidence by: Based on record review and interview, Outlet D showed to have been impacted with an ALE of 12 ppb. This result indicates out of compliance over (ALE) 5.5 ppb, which poses a potential health, safety or personal rights risk to persons in care.
