- Lead Testing (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement is not met as evidenced by: During today's inspection, Director stated that the facility has tested their water, however did not test their water until 08/2023, which is after the due date to test the facility water of 01/01/2023. Director also stated that the facility only uses the water from the sinks for the children to wash their hands. The facility has a water service that delivers water every other week which isused for children to drink. Based on record review, the facility did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care.

- Administration of Child Day Care Licensing (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: During record review and interviews, it was discovered that Director's mandated reporter training expired on 05/15/2021 and it has not been renewed. Also, Staff #2 has not completed the training at all in the last two years. Staff #2 began employment at this daycare in August 2023. - (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: During today's inspection, LPA observed two rooms that are separated by a door that the facility uses for daycare. The door remained open for the children to roam through both rooms. LPA observed five children, the Director and Staff #2 to be in one room at the same time for a short period of time, leaving the other three children left unattended in the other room. The children were not under supervision, including visual supervision, of a teacher at all times. Based on observation, the facility did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care.
