(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. Based on observation and interview, licensee did not comply with the above allegation, by having a dog accessible to children and that bit a child, which poses a potential risk to the Health, Safety and Personal Rights of children in care.
Operation of A Family Child Care Home (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan. As their age and ability permit, newly enrolled children shall be informed promptly of their duties as required in the plan. This requirement is not met as evidenced by: Licensee did not have an Emergency Disaster Plan during the inspection which poses a potential risk to the health and safety of children in care.

These rights include, but are not limited to, the following: (1) To be treated with dignity in his/her personal relationship with staff and other persons. This requirement is not met as evidenced by: Based on LPAs observation, the licensee did not comply with the section cited above. During the inspection LPA observed licensee's assistant speaking to the children in a loud and harsh tone which poses a potential risk to the personal rights of children in care.
Personal Rights To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. Licensee's dog bit three individuals at the facility. This poses an potential risk to the health and safety of children in care.
Personal Rights. Each child shall be accorded safe, healthful and comfortable accommodations, furnishing and equipment. Licensee allowed an unauthorized adult to pick up a child from school without permission from the parents. Licensee allowed a child to be picked by an unauthorized individual from school. This poses an immediate health and safety risk to the children in care.
