The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. (…) (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidenced by: Based on interview and record review, a child in care (C1) was ridiculed by a staff member (S1) based on their identity and thrown on a sleeping cot as a form of discipline, which poses an immediate risk to the health, safety, or personal rights to children in care.

This requirement was not met as evidenced by: Based on observation, interview, and record review, the Director and Assistant Director of the facility were untruthful to LPAs, which poses a potential risk to the health, safety or personal rights to children in care.
