(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation. This requirement is not met as evidenced by: Child sustained a fractured wrist while in care. Injury was not seen by any staff member present that day. This poses an immediate risk to the health and safety of children in care.

(d) Upon the occurrence... a report shall be made to the Department...wthin the Department's next working day and during its normal business hours. In addition, a written report...shall be submitted to the Department within seven days...(1) Events reported shall include the following: (B) Any injury to any child that requires medical treatment. This requirement was not met as evidenced by: A child sustained a fractured wrist witle in care and the incident was not reported to the Department.
Administration of Child Day Care Licensing (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review & interview, the licensee did not comply with the section cited above as 4 staff members did not have a current Mandated Reporter certificate which poses/posed a potential health, safety or personal rights risk to persons in care.
