Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Based on observation the licensee did not comply with the section cited above by ensuring all staff have visual supervision of children at all times which poses/posed a potential health, safety or personal rights risk to persons in care. LPA observered in two separate classroom a child used the restroom and staff did not have visual supervision of the child.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, the center did not comply with the section cited above in two of the two files reviewed, which poses a safety rights risk to persons in care.
